We are proud of the quality design and construction of the new home we have built for you, and it is of paramount importance to us that our buyers be satisfied.

A home is a unique product, one that requires your proper care and maintenance under the Wolverton Homes Limited Warranty Agreement and the attached Warranty Performance Standards (collectively, the "Warranty") you are expected to prevent damage and ensure proper functioning of your home and its various systems. In addition to the Warranty Performance Standards, you have been given other material which should give you helpful hints regarding the basic maintenance of your home.

Given the nature of production homebuilding and the large number of subcontractors and suppliers involved, it is not possible to build a 100% perfect house. Wolverton always endeavors to build a quality house on a production basis that will sell for a reasonable price. We make every effort to build our houses in a substantial conformance with local building codes and local practices and in substantial conformance to the plans and specifications approved by appropriate governmental agencies. However, we cannot guarantee perfection or exact conformance. Accordingly, unless specifically covered under the Warranty Performance Standards, Wolverton Homes will not be responsible for minor variations from such codes, plans or specifications, and deviations or errors, such as changes in nailing patterns or missing components.

WE STRONGLY URGE YOU TO READ THE WARRANTY CAREFULLY. It is intended to acquaint you with the extent of coverage and responsibility that Wolverton Homes will assume. You should also be aware that the coverage periods on certain items vary.



WARRANTY


The Builder does for a period of one year from the date of closing; warrant all materials, and workmanship used in and on the residence. The builder will repair or replace at the builder's option any latent defects in material or workmanship by the building codes and standards of construction relevant in the State of Idaho. A latent defect is defined as, one which is not apparent or ascertainable at the time of occupancy. The buyer agress to accept a reasonable match in any repair or replacement in the event that original item is no longer available.


The Builder further warrants that all materials and workmanship meet all applicable building codes in effect at the date of closing.


This limited warranty does not cover the following items:


1. Damages resulting from fires, floods, storms, electrical malfunctions, winds, accidents, or acts of God.


2. Damages from alterations, misuse, abuse, or normal wear.


3. Damages resulting from the buyer's failure to observe any operating instructions, literature, or warnings.


4. Damage resulting from malfunction of equipment or line to and from the telephone, gas, power, water, or any other utility companies.


The builder will provide the buyer at the time of closing, books or manuals with warranties that apply to the appliances, and equipment installed in the home including the heating and cooling system, light fixtures, jetted tubs, garage doors, garage door openers, gas fireplaces, smoke detectors, alarm systems, doors, timed sprinkler systems, any landscape vegetation or greenery. These warranties on said items are those of the manufacture, and or the private installer, and are not covered in this warranty by the builder.


The buyer by the acceptance of this said book acknowledges receipt of the copies of those warranties.


The builder hereby assigns (to the extent that they are assignable) and conveys to the buyer all warranties provided to the builder on said manufactured items that have been installed or are included in the buyer's property. The buyer accepts this assignment, and releases the builder from any liability or responsibility for these above mentioned items, upon closing on the property.


The buyer understands that sole remedies under this limited warranty agreement are repair and/or replacement as set forth herein.


The buyer understands that no implied warranties whatsoever apply to the structure of the house and items that are functionally part of the house. The builder disclaims any implied warranties, including but not limited to the warranties of habitability.


Non-Warrantable Conditions


1. Concrete: Concrete foundation, steps, walks, drives, patios, and porches, can and will develop cracks that do not affect the structural integrity of the building. These cracks are caused by characteristics of the concrete itself. No reasonable method of elimination of these cracks exists. This condition does not affect the strength of the dwelling.


2. Masonry, Mortar, & Grout: Masonry, mortar, and grout can develop cracks from the brick. This condition is normal and should not be considered a latent defect. The grout used on your tile (if this has been added to your home.) was sealed at the time of installation. Periodic sealing for your tile/grout is recommended in order to extend the life of your tile/grout. This periodic sealing is the responsibility of the homeowner and not the responsibility of the builder


3.Wood:
Wood will somtimes chip and crack and fibers will spread apart because of the drying process. This condition is most often caused by the heat inside the house or the exposure to the sun on the outside of the house. This condition is considered normal and the homeowner is responsible for any maintenance or repair resulting from it.


4. Sheetrock and drywall: Sheetrock and drywall will sometimes develop settlement cracks. These cracks are a normal part of the home settlement process. These cracks are only aesthetic and are not structural. They can easily be remedied with a small amount of latex caulking during the life of the home.


5. Floor squeaks: Generally, floor squeaks will appear and will disappear over time with the changes of outdoor temperature, humidity and other weather phenomenon.


6. Floors: Floors and floor coverings are not warranted for damage caused by neglect of the incidents of use. Wood, vinyl, tile and carpet will always require maintenance and occasional replacement throughout the life of your home.


7. Caulking:Exterior caulking and interior caulking in bathtubs, showers, tile surfaces window openings, and siding will shrink and crack somewhat in the months after installation. These conditions are normal and should not be considered a warrantable problem. Any maintenance or repairs resulting from them are the homeowner's responsibility.


8. Glass: Any broken or chipped glass or mirrors that are not noted by the Buyer on the final walk before closing are the responsibility of the Buyer.


9. Frozen Pipes: The Buyer must take recautions to prevent the freezing of the pipes and exterior hose faucets during cold weather such as: disconnecting the hose from the faucet prior to a freeze, leaving faucets with a single drip, and turning off the water system if the house is to be left for extended periods during cold weather.


10. Stained Wood: All items that are stained will normally have variations of color because of different textures and grains in the woods used; Because of weather changes, doors that have panels will sometimes dry out and leave a small space of bare wood. These are normal conditions and shall not be considered a warrantable item.


11.Paint: The highest quality paints have been used internaly and externally on your new home. Any defect in the paintwork that is not noted prior to closing on the walk-through is the Buyer's repsonsibility. Each home has been provided a paint-kit that contains the paint colors used in the home. Any painting that needs done and has not been noted on the walk-through list can be done using these paint kits. Any drywall repairs done by the homeowner or others should also be painted using this touchup kit.


12. Cosmetic Items: The Builder has not contracted to cover ordinary day-to-day wear and tear or other occurrences subsequent to construction that will affect the condition of the features of the home. Chips, scratches, or mars in the tile, woodwork, walls, porcelain fixture, brick, stone, marble, granite, Formica, windows, carpet, vinyl, cabinets, trim, doors and the like, that are not noted and recognized on the walk-through prior to closing, are non-warrantable conditions and the upkeep of any cosmetic aspect of the house is the owner's responsibility.


13. Plumbing: Dripping faucets, toilet adjustments, and toilet seats are covered by the Builder's warranty for a period of 90 days only. After that they are the Buyer's responsibility.


14. Roof: During the first year, the Builder's warranty on the Buyer's roof is for workmanship and materials. After that time period has expired, any warranty claims for any defect in materials will be handled by the manufacturer. The homeowner should contact the manufacturer directly to resolve any issues. The Builder will not be responsible for any damages caused by walking on the roof or by installing any items on the roof, such as antennas or television dishes.


15. Furnace & Air conditioning: One of the fundamental systems of your home is the furnace and air conditioning unit. We urge you to read the manuals or instruction booklets that come with these units so that you can be more aware of the maintenance required to keep your system working properly. The heat and air conditioning units require you, the homeonwer, to change filters periodically. Any damage cause to the unit due to negligence in replacing air filters will be the homeowner's responsibility. If you have questions or concerns regarding how or when to change an airfilter please contact the airconditioner's manufacturer.


16. Lot & Grading: Upon completion of the home the builder will provide what is called a "rough grade" on the lot. This is not a fine grad or landscape grade. Afther the rough grade the builder is no longer responsible for any grading that needs done on the lot.
